Delaware Notice to Landlord of Early Termination of Rental Agreement

Delaware tenants, do you need to terminate your lease ⁄ rental agreement before it expires? Serve your landlord with this Notice to Landlord of Early Termination of Rental Agreement (other than month to month tenancies), pursuant to the Residential Landlord-Tenant Code.

This form of Notice is for a lease or rental agreement that runs longer than month to month. It CAN ONLY BE USED in the following circumstances:
  • relocation of the tenant's employment to a distance of greater than 30 miles;
  • serious illness of the tenant or serious illness or death of an immediate family member making relocation necessary;
  • the tenant is being admitted to senior citizens or subsidized housing;
  • the tenant is entering into active military service;
  • the death of the tenant.
The Notice informs the landlord that the rental agreement will terminate in 30 days, beginning on the first day of the month following the date the notice is given. A Service of Notice Form is included to record the details of the method of service.
